O que diz a lei?
O Código de Defesa do Consumidor (CDC) determina que os serviços públicos essenciais sejam contínuos e não possam ser interrompidos, conforme art. 22. Isso não significa que a empresa possa cobrar os inadimplentes e suspender o fornecimento de luz. O nome do consumidor pode ser inserido no Cadastro de Proteção ao Crédito, mas a cobrança não pode ser vexatória ou expor o consumidor a constrangimento (arts. 42 e 71 do CDC).
A Lei nº 14.015/2020, permite o corte desde que o consumidor seja notificado previamente da interrupção do serviço. O corte só poderá ocorrer em dias úteis e em horário comercial, isto é, das 8h00 às 18h00. Também é proibido que o desligamento inicie às sextas-feiras, sábados, domingos, feriados e vésperas (art. 5º, inciso XVI e art. 6º, §4º). Antes disso, o consumidor era prejudicado, pois tinha que aguardar o próximo dia útil para restabelecer o serviço.
Como saber se vou ter a luz cortada?
O consumidor que estiver inadimplente precisa ser comunicado previamente sobre o desligamento. Esse aviso geralmente é realizado na própria fatura, a notificação precisa ser escrita, impressa e com comprovação de entrega ao consumidor. No caso de inadimplência, é obrigatório que o fornecedor notifique o consumidor, 15 dias antes do corte da luz (Resolução Normativa nº 1000/2021 da Aneel, art. 360, inciso II).
O que fazer se eu tiver a luz cortada?
Se você tiver a luz cortada, deve verificar se houve notificação. Se não houve notificação, a interrupção é indevida e você pode ir à justiça e pedir indenização por dano moral.
Você também pode tentar negociar os débitos em aberto com a empresa. A conciliação é uma boa opção para evitar o corte do serviço e para ambas as partes saírem ganhando.
Posso ter a luz cortada por contas antigas?
A justiça tem firme posicionamento de que o corte de serviços essenciais, como água e energia elétrica, pressupõe o inadimplemento de conta regular, relativa ao mês do consumo, sendo inviável, a o corte de energia em razão de débitos antigos. Caso você tenha sua energia cortada por dívidas antigas, pode buscar uma indenização na justiça com advogado de sua confiança.
Como funciona a tarifa social de luz?
As famílias de baixa renda, sem condições financeiras, têm direito à tarifa social de luz. Trata-se de uma política pública para os consumidores inscritos no cadastro único ou no Benefício de Prestação Continuada (BPC). Os requisitos para obter o benefício estão na Lei nº 12.212/2010 e no Decreto nº 7.583/2011.
Para saber se você tem direito à tarifa social, você pode entrar em contato com a sua distribuidora de energia elétrica.

E se tiver a luz cortada por estar inadimplente, verifique se houve notificação, do contrário a interrupção é indevida e você pode ir à justiça e pedir indenização por dano moral.
